Design Contract Templates

The following documents are approved by the Office of the President and the Office of General Counsel for use by the facility. Instructions and cover sheets contained in these documents are for the facility only and should be removed prior to distribution. Documents identified as "Core Documents" shall not be modified by the facility. Any revisions to these templates are made and issued by the Office of the President.

1. Balcony Bill PSA

Used for Balcony Bill-related inspections, as they may require a combination of professional services and construction work related to the inspections.

2. Construction Management Agreement

Used to contract with a licensed architect, registered engineer, or licensed general contractor for some or all the services involved with managing UC construction contracts. The contract is not used when the professional will be performing any of the actual construction or design work for the project.

4. EDPA Blanket Agreement

Used as a “Blanket Agreement” to contract with executive architects and executive engineers who are licensed within the state of California for a specific period of time. When a facility is ready to use the executive consultant's services, a written authorization describing the services is executed.

5. EDPA for CM at Risk Delivery

Used to contract with executive architects and executive engineers who are licensed within the state of California for a CM at Risk project.

6. EDPA Lite with Any Delivery Method

Used for design services on a project where the expected fee plus reimbursables does not exceed $100K. It could be used to contract with an architect of record, engineer of record or for other design services as long as it meets the dollar threshold. It could also be used for one or more phases of design, plus for programmatic studies, when needed.

8. Professional Services Agreement

Used to contract when consultant services may be required for planning, design, and construction services for multiple efforts within a specific period of time. When a facility is ready to use the consultant's services, a written authorization describing the services is executed. Examples of this work include land surveys, environmental studies, planning, testing, cost estimating, etc.

Construction Contract Templates

The following documents are approved by the Office of the President and Office of the General Counsel for use by the Facility. A facility may place its logo on the Cover page. Each template document starts with a cover sheet and set of instructions. These instructions are for the Facility only and should not be added to the Contract Documents when distributed to the Bidder or Contractor.

1. 179D/Inflation Reduction Act (IRA) Funding

Used in conjunction with the base contract documents when 179D/Inflation Reduction Act/ITC funding or tax refunds are being pursued. These documents provide instructions on sections to be added, deleted, or modified in the existing contract templates and should not be added as-is to the Contract Documents when distributed to the Bidder or Contractor.

2. Best Value Contractor Selection

Public Contract Code Section 10506.4 et seq., provides for a program for projects over one million dollars ($1,000,000) that allows the University to award construction contracts to the lowest responsible bidder selected based on the “best value”, as defined in Section 10506.5.

4. Brief Form Contract Templates

Used for any project with an estimated construction contract sum of up to $1 million. For complex or riskier projects, use the Long Form.

5. CM at Risk Contract Templates

Used to contract with a firm that provides construction management services during design and bidding and assumes responsibility for the construction phase with competitive bidding amongst the subcontractors.

9. Job Order Contracting (JOC) Contract Templates

Used to establish time-limited master agreements, under which construction projects that are well-defined, recurring, or projects that have repetitive work where quick execution is essential. It is not used for single projects.

10. Long Form Contract Templates

Used for complex project scopes or lump sum fixed price construction projects over $1 million. It can be used for projects below $1 million.
