The following documents are approved by the Office of the President and Office of the General Counsel for use by the Facility. A facility may place its logo on the Cover page. Each template document starts with a cover sheet and set of instructions. These instructions are for the Facility only and should not be added to the Contract Documents when distributed to the Bidder or Contractor. 

1. 179D/Inflation Reduction Act (IRA) Funding

Used in conjunction with the base contract documents when 179D/Inflation Reduction Act/ITC funding or tax refunds are being pursued. These documents provide instructions on sections to be added, deleted, or modified in the existing contract templates and should not be added as-is to the Contract Documents when distributed to the Bidder or Contractor.

2. Best Value Contractor Selection

Public Contract Code Section 10506.4 et seq., provides for a program for projects over one million dollars ($1,000,000) that allows the University to award construction contracts to the lowest responsible bidder selected based on the “best value”, as defined in Section 10506.5.

4. Brief Form Contract Templates

Used for any project with an estimated construction contract sum of up to $1 million. For complex or riskier projects, use the Long Form.

5. CM at Risk Contract Templates

Used to contract with a firm that provides construction management services during design and bidding and assumes responsibility for the construction phase with competitive bidding amongst the subcontractors.

9. Job Order Contracting (JOC) Contract Templates

Used to establish time-limited master agreements, under which construction projects that are well-defined, recurring, or projects that have repetitive work where quick execution is essential. It is not used for single projects.

10. Long Form Contract Templates

Used for complex project scopes or lump sum fixed price construction projects over $1 million. It can be used for projects below $1 million.
